Andrew's legal practice focuses on a balance of complex commercial suits, personal injury actions, and product liability claims. Andrew has positioned himself within the firm as the go-to attorney for issues regarding state and federal consumer protection statutes. He has successfully defended claims under the Colorado Consumer Protection Act at both the trial and appellate levels, and he is routinely asked by lawyers both within and outside the firm to consult on consumer protection issues in a variety of contexts. In addition to his trial-tested experience litigating consumer protection claims, Andrew has successfully defended numerous product liability suits for major automobile manufacturers. Beyond his professional pursuits, Andrew is an active member in the legal and non-profit community, having helped the firm win the annual Legal Aid Foundation associates' fundraising campaign in 2010, and mentoring first-year law students through the Lawyering Process program at the University of Denver's Sturm College of Law.
Highlights from Mr. Unthank's litigation experience include:
- Serving as the first-chair litigator on behalf of a Fortune 100 company against a former dealer and obtaining an arbitration award including the full principal amount claimed plus attorneys fees and costs.
- Serving as the second-chair litigator along with the firm's managing partner, Hugh Gottschalk, on behalf of a local franchising company and obtaining a complete defense judgment at the conclusion of a five-week trial involving breach of contract, fraud, and consumer protection claims.
- Developing a successful legal challenge to class-action claims brought under the Colorado Consumer Protection Act against a national nursing home chain and its affiliated companies and obtaining a complete dismissal of all consumer protection claims brought by the proposed class.
- Conducting direct and cross examinations of several witnesses at trial, including experts, and preparing company witnesses for deposition and trial testimony.
- Taking and defending the depositions of numerous lay and expert witnesses in a variety of commercial and product liability suits involving franchise, banking, and defective design issues.
- Drafting successful appellate briefs on issues relating to consumer protection act claims and bad faith breach of insurance contracts, and preparing winning summary judgment briefs in landowner premises liability suit.
