Supreme Court Allows No-Lap-Belt Preemption Ruling to Stand, Automotive Litig. Rep., at 10

12.31.2002

Citing its 2000 decision in Geier v. American Honda Motor Co. Inc., the U.S. Supreme Court on Dec. 2, 2002, declined to review an Arizona appeals court ruling (Hernandez-Gomez v. Volkswagen of America Inc.) that claims involving a rollover accident and the lack of a manual lap belt are preempted by the NTMVSA.  WTK attorney Mal Wheeler had represented Honda in Geier.
