Summary Judgment for Medical Device Manufacturer Based on Federal Preemption Law
The Superior Court for Santa Clara County, California granted summary judgment in favor of a Wheeler Trigg Kennedy client that makes a stent-graft medical device used to repair abdominal aortic aneurysms without traditional open surgical techniques. The court found that the plaintiffs' claims were preempted by federal law. The wins were especially significant because the cases involved an extension of recent United States Supreme Court preemption case law.
