Rush v. Whirlpool Corp., 2008 WL 509562 (W.D. Ark. Feb. 22, 2008)


Wheeler Trigg Kennedy attorneys defeated the plaintiffs' attempts to certify a multistate class action against Whirlpool Corporation based on allegations that certain Whirlpool-manufactured refrigerators are defective.  The victory came after an intense discovery and briefing period ordered by the court in which the plaintiffs repeatedly tried to obtain certification bamending their class definitions.  The U.S. District Court for the Western District of Arkansas agreed with WTK's arguments opposing class certification and refused to certify any class, no matter how defined.
