Rush v. Whirlpool Corp., 2008 WL 509562 (W.D. Ark. Feb. 22, 2008)
Wheeler Trigg O’Donnell attorneys defeated the plaintiffs' attempts to certify a multistate class action against Whirlpool Corporation based on allegations that certain Whirlpool-manufactured refrigerators are defective. The victory came after an intense discovery and briefing period ordered by the court in which the plaintiffs repeatedly tried to obtain certification by amending their class definitions. The U.S. District Court for the Western District of Arkansas agreed with WTO's arguments opposing class certification and refused to certify any class, no matter how defined.
