Ken's legal practice focuses on complex-commercial and product-liability litigation at the trial and appellate levels in state and federal courts across the country, as well as in alternative dispute resolution forums such as mediations and arbitrations. He represents clients in a variety of industries from financial and banking institutions, automotive manufacturers, to chemical and children's products' suppliers and manufacturers. Ken has gained extensive experience representing his clients at all stages of litigation from pre-filing negotiations to judgment. He is dedicated to achieving his client's goals in the most effective and efficient manner possible.
Some of Ken's client achievements and experience include the following:
- Shroff v. MF Global, Inc., No. 08 C 929, 2009 WL 2704582 (N.D. Ill. 2009) – Ken assisted in the summary judgment briefing that resulted in the dismissal of all but one count, which was later dismissed on a motion for reconsideration.
- U.S. v. Radley, 659 F. Supp. 2d 803 (S.D. Tex. 2009) – Ken was part of the team that obtained the dismissal of charges against its client for violations of the Commodity Exchange Act for allegedly manipulating the price of propane.
- Sanchez v. Wal-Mart Stores, Inc., No. Civ. 2:06-CV-02573-JAM-KJM, 2009 WL 1514435 (E.D. Cal. 2009) - Ken assisted in the briefing of a successful opposition to class certification in a product-liability action involving children's strollers. Ken also assisted in the successful briefing of an opposition to an MDL transfer of this case.
- In re Bextra and Celebrex Marketing Sales Practices and Product Liability Litigation, No. 08 C 402, 2008 WL 4345158 (N.D. Ill. 2008) - Ken assisted in briefing a successful motion to quash a subpoena on records of the American Medical Association's journals, the Journal of the American Medical Association and Archives of Internal Medicine.
- Tuthill Corp. v. Arvinmeritor, Inc., No. 07 C 2758, 2008 WL 4200888 (N.D. Ill. 2008) – Ken assisted in briefing a successful opposition to motion to dismiss, preserving the client's claims.
- Ken was a member of an arbitration team that successfully represented a federal agency in a two-week arbitration involving a complex contract and tax dispute resulting in an eight-figure award for the agency.
- Ken managed the day-to-day aspects of several diacetyl product-liability cases for BASF Corporation, including deposing numerous plaintiffs, co-workers, and company representatives, briefing and arguing dispositive motions in court, appearing in court for status hearings, and managing discovery and local counsel.
