Kaske v. State of Colorado Department of Transportation
On jurisdictional grounds, the Denver District Court dismissed the claim of plaintiff Rosemary Kaske who charged that a soft shoulder composed of asphalt millings in a highway construction zone caused her van to roll over resulting in the traumatic amputation of the right front passenger's arm. The first impression issue presented in the case was whether our client the State of Colorado Department of Transportation is immune from suits for construction zone accidents under the Colorado Governmental Immunity Act.
