Century Motor Corporation v. Ed Bergen, No. 09-04135 (Bankr. E.D. Mo.) and No. 09-50002 (Bankr. S.D.N.Y.)
Wheeler Trigg O'Donnell represented 12 former officers, directors and employees of debtor Chrysler LLC in claims brought by a dealer whose dealer agreement with Chrysler Motors LLC n/k/a Old Carco Motors LLC were rejected in the company's bankruptcy proceedings. Because of the relation of Century Motor's claims to the main bankruptcy case in New York, WTO successfully removed the case from state court to the Bankruptcy Court for the Eastern District of Missouri. At this stage, WTO fended off a remand challenge and successfully sought transfer of the case to the Bankruptcy Court for the Southern District of New York. Upon its arrival in New York, the case was quickly dismissed by the rejected dealer.
