In this 50-minute presentation, Wheeler Trigg O'Donnell attorneys Mark Clouatre and David Schaller will explain how to make arbitration agreements work for, and not against, you. As outside counsel for FedEx Ground and Chrysler Group, Mark and Dave will discuss actual case histories and integrate in-house counsel perspectives on the strategic and economic advantages of arbitrations. They will cover:
- How to implement strategies that effectuate the goals of an arbitration clause/agreement;
- How to overcome challenges to the language of arbitration agreements;
- How to hurdle problems and challenges in arbitration proceedings;
- How to create efficiencies in proceedings; and
- How to negotiate cost-effective fee arrangements for arbitrations.
Mark T. Clouatre is a partner with Wheeler Trigg O'Donnell. Mark is a trial-tested attorney with extensive complex litigation experience both in and out of the courtroom. He focuses his practice on commercial litigation, including franchise litigation. He also handles product liability, toxic tort, malpractice defense, and general tort cases. Mark has successfully tried more than 17 complex cases before judges and juries in trial and appellate courts and before administrative agencies in seven states from Alaska to Ohio, and has conducted numerous arbitrations from Florida to California. Mark also oversaw and managed the arbitrations of over 400 matters in 48 states in an eight-month period in 2010 for Chrysler Group.
David J. Schaller is a Wheeler Trigg O'Donnell partner with a national commercial litigation practice largely focused on complex commercial disputes, the defense of major manufacturers in franchise and distribution-related disputes, and professional liability. Dave has successfully tried complex cases in courts and before administrative agencies in numerous jurisdictions. He has also conducted numerous arbitrations across the country. Prior to becoming a lawyer, Dave worked for 12 years in business where he developed strong negotiation and management skills. His combined business and litigation skills enable him to successfully represent corporate clients in all manner of commercial, franchise work, premises, and product liability disputes.
